WHY ARE WE CONSIDERING THIS ISSUE?

On August 8, 2016, the Bozeman City Commission adopted Ordinance 1958 temporarily removing Extended Stay Lodgings (Short-Term Rentals) as a conditional use in R1, R2, RS and HMU zoning districts – which means the City will not issue any new permits for this use in these zones. The Commission directed staff to investigate the issue, research best practices, solicit public input, and provide options for Commission consideration prior to the expiration of the Ordinance on February 8, 2017. The work of the City on this issue applies only to property within the city limits of Bozeman.

WHAT IS A SHORT-TERM RENTAL?

Short-Term Rental (STR) is a term commonly used to describe the rental of rooms or dwellings to paying guests for a period of time generally between 1-29 days. Due in part to online hosting platforms like AirBnB, Homeaway, VRBO, and others, this industry has grown rapidly in recent years. In Bozeman we currently refer to these as Extended Stay Lodgings.

WHAT ARE THE CURRENT REGULATIONS?

Prior to the adoption of Ordinance 1958, the City allowed extended stay lodgings in the R1, R2, RS and HMU zoning districts with a Conditional Use Permit. These are an allowed use in all other zoning designations. In addition, a business license is required that is routed to various City Departments to ensure compliance with all City requirements.
